These Terms of Service (“Terms”) govern access to and use of the websites operated by New Glory International, including terrymacalmon.com and newglory.org (collectively, the “Websites”), and the purchase or use of products, digital content, charitable giving opportunities, and other services made available through the Websites.
New Glory International (“New Glory,” “NGI,” “we,” “us,” or “our”) is a nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code.
By completing a transaction, creating an account, making a donation, enrolling in recurring giving, or otherwise affirmatively agreeing to these Terms, you agree to be bound by them. Your general use of the Websites is also subject to these Terms to the extent permitted by applicable law.
If you do not agree to these Terms, please do not complete a transaction or use any feature requiring acceptance of these Terms.
1. Eligibility and Authority
You must have the legal capacity to enter into a binding agreement in order to purchase products, make donations, establish recurring giving arrangements, or enter into other transactions through the Websites.
If you act on behalf of an organization, church, ministry, business, or other entity, you represent that you have authority to bind that entity to the applicable transaction and these Terms.
You agree to provide accurate, current, and complete information when completing a transaction and to promptly correct information that is materially inaccurate.
2. Products, Resources, and Services
New Glory may offer physical products, digital products, ministry resources, gift cards, donation opportunities, recurring giving programs, event information, and other products or services.
Product descriptions, availability, prices, and other information may change from time to time. We make reasonable efforts to present information accurately but may correct typographical, pricing, inventory, or technical errors.
A product listing or other Website content does not constitute an irrevocable offer. We may reject or cancel an order before fulfillment where reasonably necessary because of an error, lack of availability, suspected fraud, sanctions or legal restrictions, payment failure, or another legitimate reason. If we cancel a paid order, we will refund amounts paid for the cancelled portion of the order unless prohibited by law.
3. Prices, Payment, and Taxes
Prices are displayed in the currency identified at checkout.
You authorize New Glory and its payment service providers to charge the payment method you select for the amount displayed and authorized at checkout.
Applicable sales, use, transaction, shipping, or similar taxes may be collected where required by law. New Glory’s federal tax-exempt status does not necessarily exempt purchases made by customers from applicable sales or use taxes.
Payment processing may be performed by third-party payment providers and may also be subject to their terms and privacy practices.
4. Physical Products and Shipping
Shipping options, charges, estimated processing times, available destinations, and other shipping information are described in our Shipping Policy and, where applicable, at checkout.
Estimated processing, shipping, or delivery times are estimates unless expressly stated otherwise and are not guarantees.
New Glory may use third-party postal or delivery services. Events outside our reasonable control may affect delivery. Nothing in these Terms limits any right to cancellation, replacement, refund, or other remedy that applicable law requires New Glory to provide because an order was not shipped or delivered as required.
Customers are responsible for providing a complete and accurate delivery address. Additional customs duties, import taxes, brokerage fees, or similar charges imposed by a destination country may be the responsibility of the recipient where permitted by applicable law and disclosed during or before purchase.
5. Returns, Refunds, and Order Cancellations
Returns, refunds, exchanges, and order cancellations are governed by our Refund Policy, Shipping Policy, and any additional terms presented at the time of purchase.
Nothing in those policies or these Terms limits a remedy that cannot lawfully be waived.
Where New Glory agrees to issue a refund, it will ordinarily be returned to the original payment method unless another method is required by law or agreed with the customer.
6. Digital Products
Digital products may include music files, eBooks, sheet music, accompaniment tracks, downloadable documents, videos, or other digital content.
Unless a product page or separate license expressly provides otherwise, purchase of a digital product grants the purchaser a limited, non-exclusive, non-transferable license for personal and lawful use. Ownership of the underlying intellectual property is not transferred.
You may not reproduce, distribute, resell, publicly upload, sublicense, commercially exploit, or create unauthorized derivative works from digital products except with prior authorization from the applicable rights holder or as otherwise permitted by law.
Specific sheet music, accompaniment-track, performance, church-use, synchronization, reproduction, or other rights may be governed by separate licensing terms. If specific license terms accompany a product, those terms control with respect to that product.
7. Gift Cards
Gift cards or stored-value products offered by New Glory are subject to applicable federal and state law and to any additional terms disclosed at purchase.
Any expiration, fee, replacement, redemption, or cash-refund provisions will be administered in accordance with applicable law.
Unless required by law or expressly stated otherwise, gift cards may not be redeemed for cash.
8. Charitable Contributions
New Glory accepts charitable contributions in support of its religious and charitable mission.
8.1 Tax Treatment
New Glory is recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code. Contributions may be deductible for U.S. federal income tax purposes to the extent permitted by applicable law.
The deductibility of a particular payment depends on the circumstances, including whether the donor receives goods, services, benefits, or privileges in connection with the payment. New Glory does not provide individual tax, accounting, or legal advice. Donors should consult their own professional advisers regarding their circumstances.
New Glory will provide donor acknowledgments and legally required disclosures where applicable.
8.2 Donor Designations
Unless New Glory expressly accepts a legally binding restriction, donations are made to New Glory in support of its charitable mission and remain subject to New Glory’s ultimate control and discretion consistent with applicable law.
Where a donation page permits a donor to indicate a ministry, project, program, or purpose, that indication will be treated as a donor preference unless New Glory expressly states that it is accepting the contribution as a restricted charitable gift.
Where New Glory expressly accepts a restricted contribution, New Glory will administer the contribution in accordance with the accepted restriction and applicable law.
8.3 Donation Refunds
Charitable contributions are ordinarily irrevocable and non-refundable once completed.
New Glory may, however, correct or refund a contribution when appropriate because of a duplicate payment, processing error, unauthorized transaction, legal requirement, inability to accept the contribution, or another circumstance that New Glory reasonably determines warrants correction or refund.
8.4 Recurring Contributions
If you authorize a recurring contribution, you authorize New Glory or its payment processor to charge the amount and at the frequency clearly disclosed at the time you enroll.
Recurring contributions continue until cancelled, unless a different duration is expressly stated when you enroll.
You may cancel future recurring contributions using the cancellation method provided with the recurring giving program or by contacting New Glory. Cancellation does not ordinarily reverse contributions already processed before the cancellation becomes effective.
Any benefits associated with a recurring giving program will be described separately. New Glory may change or discontinue program benefits prospectively, subject to applicable law and any specific commitments previously made.
9. Event Appearances and Bookings
Information concerning concerts, worship events, ministry appearances, speaking engagements, or other events may be provided through the Websites.
Any formal booking of Terry MacAlmon, New Glory International, or another ministry representative is subject to the separate written booking agreement, rider, or other terms issued for that engagement. In the event of a conflict between these Terms and a signed booking agreement, the booking agreement controls with respect to that engagement.
10. Intellectual Property
The Websites and their content, including music, recordings, compositions, lyrics, sheet music, videos, photographs, artwork, graphics, text, logos, trademarks, and other materials, are owned by or licensed to New Glory or other rights holders and are protected by applicable intellectual property laws.
Except for rights expressly granted in connection with a purchased product or other written license, no right, title, or interest in intellectual property is transferred to you.
You may access Website content for personal and lawful purposes. You may not reproduce, publish, distribute, sell, commercially exploit, remove rights-management information from, or otherwise use protected content without authorization except where such use is permitted by applicable law.
11. Prohibited Uses
You may not use the Websites to violate applicable law or the rights of another person.
You may not knowingly interfere with the security, availability, or operation of the Websites; obtain unauthorized access to systems or accounts; introduce malicious code; conduct fraudulent transactions; impersonate another person; or use automated systems in a manner that materially disrupts the Websites or circumvents access controls.
Reasonable use of ordinary search engines and other legitimate indexing services is not prohibited by this section merely because automated technology is involved.
12. Third-Party Services and Links
The Websites may contain links to, integrations with, or services provided by third parties, including payment processors, video platforms, social media services, shipping providers, and other service providers.
New Glory does not control third-party services and is not responsible for their independent content, availability, security, terms, or privacy practices. Your use of third-party services may be governed by separate agreements between you and those providers.
13. Privacy and Data Security
New Glory’s collection, use, retention, and disclosure of personal information is described in our Privacy Policy.
The Privacy Policy is intended to provide information regarding our privacy practices. Where applicable law requires separate consent for a particular form of processing, such consent will be requested separately.
New Glory may take reasonable actions to protect the security and integrity of the Websites, transactions, donor information, customer information, and other data. No Internet-based system can, however, be guaranteed to be completely secure.
14. Sanctions, Fraud, and Legal Compliance
New Glory may review, decline, suspend, reject, block, or refund a transaction where reasonably necessary to comply with applicable law, economic sanctions, payment-network requirements, fraud-prevention requirements, court orders, governmental restrictions, or other legal obligations.
Nothing in these Terms requires New Glory to process a transaction that New Glory is legally prohibited from processing.
15. Ministry and Informational Content
Religious teaching, testimony, spiritual resources, articles, videos, music, and other ministry content made available through the Websites are provided for religious, educational, and informational purposes.
Unless expressly stated otherwise by an appropriately qualified professional acting in that professional capacity, Website content is not intended as individualized medical, mental-health, legal, tax, investment, or other regulated professional advice.
Nothing in this section limits liability or responsibility that applicable law does not permit New Glory to exclude.
16. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR ANY EXPRESS WARRANTY OR RIGHT THAT NEW GLORY EXPRESSLY PROVIDES OR THAT APPLICABLE LAW DOES NOT PERMIT TO BE EXCLUDED, THE WEBSITES AND WEBSITE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEW GLORY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT WITH RESPECT TO THE WEBSITES AND SERVICES.
WITH RESPECT TO GOODS SOLD THROUGH THE WEBSITES, THIS DISCLAIMER APPLIES ONLY TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED AND DOES NOT NEGATE AN EXPRESS WARRANTY CREATED BY AN EXPRESS AFFIRMATION, PROMISE, PRODUCT DESCRIPTION, OR OTHER LEGALLY BINDING WARRANTY.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN THOSE JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
17. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEW GLORY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO USE OF THE WEBSITES OR A TRANSACTION COVERED BY THESE TERMS, TO THE EXTENT SUCH DAMAGES MAY LAWFULLY BE EXCLUDED.
TO THE FULLEST EXTENT PERMITTED BY LAW, NEW GLORY’S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE OR PAID SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO NEW GLORY FOR THE PURCHASE OR SERVICE GIVING RISE TO THE CLAIM.
THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING LIABILITY TO THE EXTENT ARISING FROM FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, PERSONAL INJURY WHERE SUCH A LIMITATION IS PROHIBITED, OR ANY OTHER LIABILITY THAT APPLICABLE LAW DOES NOT PERMIT THE PARTIES TO LIMIT.
NOTHING IN THESE TERMS WAIVES OR LIMITS ANY RIGHT OR REMEDY UNDER APPLICABLE CONSUMER-PROTECTION LAW THAT CANNOT VALIDLY BE WAIVED.
18. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold New Glory harmless from third-party claims, damages, and reasonable costs arising directly from your unlawful misuse of the Websites, your material violation of these Terms, or your knowing infringement of a third party’s rights.
This provision does not require a consumer to indemnify New Glory for New Glory’s own unlawful conduct, negligence, or other liability for which indemnification may not lawfully be required.
19. Suspension or Termination
New Glory may restrict or suspend access to Website features when reasonably necessary because of material violation of these Terms, fraudulent or unlawful activity, threats to Website security, abuse of New Glory’s systems, or legal requirements.
Termination or suspension does not eliminate rights or obligations arising from transactions completed before termination.
20. International Users
The Websites may be accessible outside the United States. Availability of a Website or product in a jurisdiction does not constitute a representation that every product, feature, shipment, or transaction is lawful or available in that jurisdiction.
International customers remain responsible for applicable local import requirements where permitted by law.
Nothing in these Terms is intended to deprive a consumer of mandatory rights under the law of the consumer’s jurisdiction where those rights cannot lawfully be waived by agreement.
21. Governing Law and Venue
Except to the extent mandatory law requires otherwise, these Terms and disputes arising from them are governed by the laws of the State of Texas, without regard to conflict-of-law principles, together with applicable federal law.
Subject to any mandatory jurisdictional rights that cannot lawfully be waived, any judicial proceeding arising from or relating to these Terms shall be brought in a state court of competent jurisdiction in Collin County, Texas, or in the United States District Court for the Eastern District of Texas, Sherman Division, if federal subject-matter jurisdiction exists.
Each party consents to personal jurisdiction in those courts to the extent such consent is legally effective.
22. Changes to These Terms
New Glory may revise these Terms from time to time.
The effective date or “Last Updated” date will be revised when changes are published. Changes apply prospectively from their effective date unless applicable law permits or requires otherwise.
If a change materially affects an existing recurring arrangement or another continuing contractual relationship, New Glory will provide additional notice or obtain additional consent when required by applicable law.
Changes to these Terms do not retroactively alter rights or obligations arising from a completed transaction unless the parties validly agree otherwise or applicable law requires the change.
23. Relationship With Other Policies
These Terms should be read together with the policies applicable to the relevant transaction, including the Privacy Policy, Shipping Policy, Refund Policy, Cancellation Policy, and any recurring-giving, gift-card, product-license, or booking terms presented to you.
If transaction-specific terms expressly conflict with these general Terms, the transaction-specific terms control with respect to that transaction.
24. Severability
If a court of competent jurisdiction determines that a provision of these Terms is invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary, and the remaining provisions will remain in effect.
25. No Waiver
A failure or delay by New Glory in exercising a right under these Terms does not waive that right.
26. Assignment
You may not assign contractual rights or obligations arising from an individual transaction without New Glory’s prior written consent where such consent may lawfully be required.
New Glory may transfer its rights and obligations in connection with a lawful reorganization, succession, transfer of operations, or similar transaction, subject to applicable law and without impairing non-waivable consumer rights.
27. Entire Agreement
These Terms, together with applicable transaction-specific terms and policies incorporated into a particular transaction, constitute the agreement between you and New Glory regarding the subject matter they cover.
Nothing in this section excludes representations, warranties, rights, or remedies that applicable law does not permit the parties to exclude.
